The Cannabis Legalisation and Regulation Secretariat has published the draft legislation and the accompanying Policy Statement for the Decriminalisation of Cannabis in Grenada. The legislation, which will be tabled in Parliament on Tuesday, 20 January, is titled the Drug Abuse (Prevention and Control) Amendment Bill, 2026.
The draft Bill and the accompanying Policy Statement are available on the Cannabis Legalisation and Regulation Secretariat website.
The draft Bill provides for the following:
- Decriminalisation of Small Amounts: It permits the possession of up to 56 grams of cannabis and 15 grams of resin for individuals aged 21 and older.
- Registered Household Cultivation: It allows for the growth of up to 4 cannabis plants per household for medicinal, therapeutic, or horticultural purposes.
- Religious Recognition: It provides a legal framework for the Rastafarian faith to use and cultivate cannabis as a sacrament in registered places of worship and at “exempt events”.
- Social Justice: It mandates expunging past criminal records and immediately discontinuing pending court cases for minor cannabis offences.
- Youth Protection: It replaces criminal charges for individuals aged 18–20 with mandatory rehabilitation and counselling, ensuring no criminal record is created.
What the draft Bill is NOT:
- NOT Full Legalisation: It does not create an unrestricted recreational market.
- NOT a “Public Smoking” Permission: Smoking in public remains an offence subject to fixed penalties (EC$300), with strict prohibitions within 100 yards of schools and 5 metres of public entrances.
- NOT for Minors: Use and access remain strictly prohibited for anyone under 21; adults who exploit young adults and children for cannabis activities face severe criminal penalties.
- NOT Unregulated: The Bill paves the way for a comprehensive, robust and well-regulated cannabis industry.
